Agreement to terms
By accessing or using novuslearning.academy, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users of the site, including students, parents, and visitors. Novus Learning reserves the right to update these terms at any time. Continued use of the site after changes constitutes acceptance of the updated terms.
Description of service
Novus Learning provides ACT preparation courses, diagnostic exams, study materials, and related educational content. Our services are designed to help students improve their ACT scores through structured, self-paced learning. We offer multiple plan tiers — Novus Foundations, Novus Complete, and Novus Mastery — each providing different levels of access to our course content.
Account registration
To access our services, you must create an account using Google Sign-In. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to provide accurate information and to keep your account information up to date. You must be at least 13 years old to create an account. Students under 18 should have parental awareness and consent before purchasing a plan.
Purchases and payments
All purchases are processed securely through Stripe. By making a purchase, you agree to pay the listed price for the selected plan. All prices are in US dollars. Payments are one-time and non-recurring — we do not charge subscription fees without your explicit consent. We do not store your payment information. All financial data is handled exclusively by Stripe in accordance with their terms and PCI-DSS standards.
Refund policy
Due to the digital nature of our products, all sales are final. We do not offer refunds after course access has been granted. If you experience a technical issue that prevents you from accessing the course content you purchased, please contact us at contact@novuslearning.academy within 7 days of purchase and we will work to resolve the issue or provide a remedy at our discretion. The Novus Mastery score improvement guarantee has specific terms outlined at time of purchase.
Course access
Upon successful payment, you will receive immediate access to the course content included in your selected plan. Access is granted to the individual purchaser only and may not be shared, transferred, or resold. Novus Learning reserves the right to revoke access if we determine that account sharing or unauthorized access is occurring. Course content is subject to change as we improve and update our materials.
Intellectual property
All content on novuslearning.academy — including course materials, videos, lesson content, practice exams, worksheets, study plans, and the Novus frameworks — is the intellectual property of Novus Learning and is protected by copyright law. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our content without our prior written consent. Personal, non-commercial use for your own ACT preparation is permitted.
Acceptable use
You agree to use Novus Learning only for lawful purposes and in a way that does not infringe the rights of others. You may not share your account credentials, resell access to our content, use automated tools to scrape or download course materials, attempt to circumvent any security features, or use the platform in any way that could damage or impair our services. Violations may result in immediate account termination without refund.
Diagnostic exam and results
Our diagnostic exam is designed as an educational tool to help identify areas for improvement. Exam results and score projections are estimates based on your performance and are not guarantees of actual ACT performance. Results may vary based on many factors including test day conditions, preparation effort, and individual aptitude. We make no guarantee that use of our services will result in a specific score improvement.
Score improvement guarantee
The Novus Mastery plan includes a score improvement guarantee under specific conditions. To be eligible, you must complete all required modules and practice exams, follow the 60-day study plan, and take an official ACT exam within 90 days of purchasing the plan. Full guarantee terms are provided at time of purchase. The guarantee applies to students who complete the full program as designed and does not apply to students who do not complete the course requirements.
Disclaimer of warranties
Novus Learning is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or completeness of our content. We do not guarantee that our services will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of our services is at your own risk.
Limitation of liability
To the fullest extent permitted by law, Novus Learning and its founders shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability to you for any claims arising from your use of our services shall not exceed the amount you paid to us in the 12 months preceding the claim.
Privacy
Your use of Novus Learning is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using our services, you consent to the practices described in our Privacy Policy. Please review our Privacy Policy at novuslearning.academy/privacy.
Governing law
These Terms of Service are governed by the laws of the United States. Any disputes arising from these terms or your use of our services shall be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association rules.
